- Manufacturing/ Possession with intent to distribute. It is illegal to manufacture drugs. Even though marijuana is legal in Delaware, it is still illegal to grow your own marijuana plants. Similar to possession, possession with intent to distribute is illegal. The quantity of drugs in your possession, as well as the state of those drugs (IE, divided into individual baggies), can turn a simple possession charge into a possession with the intent to distribute charge.
- Conspiracy to commit a drug crime. When two or more people all agree to commit a drug-related crime, they may be charged with conspiracy to commit a drug crime. What differentiates this charge from other drug charges is the involvement of more than one person.
What About Marijuana?
In 2023, Delaware became the 22nd state to legalize marijuana. This comes with many caveats in The First State. As mentioned above, you are not allowed to grow your own marijuana plants. The new marijuana laws will enable a person 21 or older to carry up to one ounce of marijuana for personal use. Marijuana can only be bought through authorized establishments, and since there aren’t any yet, there is technically no legal way to purchase marijuana in Delaware just yet. However, the gift of marijuana is legal.
Even with the legalization of marijuana in Delaware, employers can still drug test you and deny employment or fire you for having marijuana in your system.
