We Work Well with Others
Many of our cases involve referrals and co-counsel relationships with other attorneys. In cases where counsel refers the client to us, we share our fees as permitted by the applicable state ethics rules. In cases where we co-counsel with an outside attorney to bring the case along through trial and appeal, we typically enter an arrangement to share costs, share the workload and split the fee proportionately. In personal injury and wrongful death cases, we typically work on what is referred to as a contingency fee. Under a contingency fee, the client pays a fee at the end of the case. The fee is typically a percentage of the settlement or award. Our contingency fee will typically range from 1/3 of the settlement to 2/5 of the settlement. The contingency fee will be discussed with you before we start representing you. The fee agreement will be in writing, and it will require your signature.
Costs of Prosecution
In personal injury and wrongful death cases, it can cost thousands of dollars to bring a case to trial. On the lower end of the spectrum, we have been fortunate to settle car accident personal injury cases with only several hundred dollars of case expenses. Conversely, we have handled complex medical malpractice cases and complex commercial trucking cases where the costs of expert witnesses, filing fees, medical records, depositions, etc., are truly in the tens and hundreds of thousands of dollars. Don’t worry-you don’t need to be a millionaire to be able to afford to prosecute a complex personal injury or wrongful death case. If we take your case, we will spend the money necessary to prosecute the case fully and properly. Case expenses that we advance then will be repaid from your settlement or award.
