Survey: Should The Cops Check Your Phone?

Attorney Ben Schwartz wants to know if you think it’s fair when cops check your phone after a traffic stop or car accident. Should police be able to confiscate and crack your phone after an accident? What do you think?

I’m attorney Ben Schwartz and I want to tell you about a scenario and I want to ask you a question because I want to know what people think. In the state of New York, there’s a bill pending. I don’t think it’s been passed as an actual law, but I think there’s a bill pending in state in New York that says that if someone gets in a car accident, the police can take his or her phone and crack it.

They basically connect to a computer, run some special software and determine if the motorist was texting or talking on the phone at the time of the accident. This way, the police can determine what the cause of the accident was and whether to cite someone for texting, violation of the texting and driving law, or violation of the no use of the cell phone law. They can basically do a root cause analysis and determine if they think that the drivers’ inattention to the roadway is what caused the accident. This will tell them if the driver was actually paying attention to the road or not.

There’s a law that’s about to be passed, or maybe not pass. I don’t know, because I am not in New York. It is pending in the New York legislature and it’ll let the police take your cell phone after an accident. They will figure out if you’ve been texting or talking on the phone at the time of the car accident. I want to know if people think that’s a good thing or a bad thing. Should cops check your phone

I can see both sides of the argument. On the one hand, people should have a right to privacy and the police shouldn’t be able to just take your phone, search it, and determine what you’ve been doing. On the other hand, a lot of people are injured and killed; like thousands of people who are injured every year in the United States of America. If this is something that could cut down on the number of accidental injuries and accidental deaths than I think that’s a good thing too. I’m conflicted! I want to know what you think.
